The Problem: No writing = No rights to govern from the grave, or worse, in the event of your incapacity. Without a written and properly executed estate plan, you don’t get to determine WHO manages and receives your assets, or HOW they are managed and received. • Who in your family receives your estate when you die – even if you don’t want them to have it
• Who in your family has authority to control your financial and legal matters if you lose capacity – even if you don’t want them to
• Who has authority to seek permission from a judge to care for you, or place you in a care facility, in the event of your incapacity – even if you don’t want them to
